RT8 Digital Group Terms & Conditions

Welcome to RT8 Digital Group. These Terms and Conditions ("Terms") govern your use of our websites, applications, and services, including but not limited to talentdirectory.co.za. By accessing or using any part of our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
1. Acceptance of Terms
By using RT8 Digital Group's services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. These Terms constitute a legally binding agreement between you and RT8 Digital Group.
2. Services Provided
RT8 Digital Group offers a diverse range of digital services, including:
- Talent Directory Platform: A platform for connecting talent with opportunities, including profile management, job postings, and communication tools.
- Web and Mobile Application Development: Custom software solutions, including design, development, deployment, and maintenance of websites and mobile applications.
- Digital Marketing Services: SEO, social media management, content creation, and online advertising campaigns.
- IT Consulting: Strategic advice, system integration, and technical support.
- RT8 Music Services: Music distribution, record label management, artist development, and related contractual agreements.
- RT8 Shop E-commerce: Online sales of digital and physical products, including payment integration for all RT8 Digital Group offerings.

3. User Accounts
To access certain features of our services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4. Payment Terms for Tech Projects (Web & App Development)
For custom web and mobile application development projects, the following payment structure applies:
- 50% Upfront Payment: A non-refundable deposit of 50% of the total project cost is required before any development work commences. This payment covers initial planning, resource allocation, and preliminary design.
- Milestone Payments: The remaining project cost will be structured into milestone payments, agreed upon in a separate project proposal or contract. Each milestone payment is due upon the completion and client approval of the corresponding project phase.
- Final Payment: The final payment is due upon project completion and before final deployment or handover.
- Payment Gateway: All payments are processed securely through PayFast or other agreed-upon payment methods.
5. Refund Policy
All sales and service agreements are generally final. Refunds will only be available for certain cases and are subject to the following conditions:
- No Refunds for Change of Mind: We do not offer refunds for services or products purchased due to a change of mind, dissatisfaction with features clearly advertised, or failure to utilize the service/product.
- Refunds for Tech Projects (Web & App Development):
- The 50% upfront payment for tech projects is **non-refundable**. This covers the initial investment in project setup and resources.
- For subsequent milestone payments, refunds may be considered only if RT8 Digital Group fails to deliver the agreed-upon deliverables for that specific milestone, and a resolution cannot be reached. Any such refund will be pro-rated based on the work completed and the specific terms outlined in the project contract.
- Once a project phase or milestone has been approved by the client, the payment for that phase becomes non-refundable.
- Refunds for Digital Products/Subscriptions (e.g., Talent Directory):
- Generally, digital product and subscription sales are final.
- A refund may be considered only in exceptional circumstances, such as proven non-delivery of the digital product/service or a major, persistent technical defect that prevents core functionality, and RT8 Digital Group is unable to provide a satisfactory resolution within a reasonable timeframe.
- Refund Request Process:
- All refund requests must be submitted in writing to info@rt8.co.za within 7 days of the purchase date or within 7 days of the event triggering the refund eligibility.
- The request must include your order details, transaction ID, and a detailed explanation of why you believe you are eligible for a refund, including evidence of non-delivery or major defect.
- RT8 Digital Group will review your request and may require additional information or troubleshooting attempts.
- Refund decisions are at the sole discretion of RT8 Digital Group. If approved, refunds will be processed back to the original payment method within 14 business days.
- Product/Service "As Is": By purchasing our products/services, you acknowledge that they are provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We strive for excellence but cannot guarantee that the product/service will be error-free or uninterrupted.
6. Intellectual Property
All content, trademarks, service marks, trade names, logos, and intellectual property displayed on RT8 Digital Group's platforms (excluding user-submitted content) are the property of RT8 Digital Group or its licensors and are protected by applicable intellectual property laws. You may not use, reproduce, or distribute any content without explicit written permission.
7. Limitation of Liability
To the maximum extent permitted by law, RT8 Digital Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use our services; (b) any conduct or content of any third party on our services; (c) any content obtained from our services; and (d) unauthorized access, use or alteration of your transmissions or content.
8. Indemnification
You agree to indemnify and hold harmless RT8 Digital Group and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of our services or your violation of these Terms.
9. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in South Africa to resolve any legal matter arising from these Terms.
10. Changes to Terms
RT8 Digital Group reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
